I am going to formally endorse @realDonaldTrump. I came to this decision some time ago as many @X followers have already understood from my supportive posts of Trump and my criticisms of @POTUS Biden.
The reason why I have not yet formally done so is that I want to explain my thinking in detail and address the arguments put forth by others against Trump. I want to make the case thoughtfully and convincingly.
Today, when one announces an intention to support Trump, Biden supporters who know me tend to assume that I have lost it. I assure you that I have made this decision carefully, rationally, and by relying on as much empirical data as possible.
It will take a long-form post to explain my thinking. I might even break my own record. I just haven’t had the time nor felt the urgency to write the post as we are still a few months from the election.
I am explaining my conclusion now in response to many questions I have received on the topic so that I am formally on the record.
You of course don’t need to care about my opinion so feel free not to read my post when it appears. That said, I believe the upcoming presidential election is one of the most consequential elections in my lifetime so I am taking the proper time to articulate observations that I will share widely and for which I assume an important responsibility.
I have had the benefit of spending a few hours recently with President Trump so I will have some first hand observations to share.
As always, I respect everyone’s right to form and share their own views on this important topic.
Please keep an open mind on the upcoming presidential election. Bear in mind that your views on Trump have likely been dramatically affected if you have sourced your info on Trump from mainstream media or friends or family who have relied on mainstream media as a source of knowledge.
We have all recently learned in the starkest manner (the debate) how we cannot rely on the MSM as our source of truth on the ultimate political question.
Remember, media organizations are like sports teams that run plays chosen by their owners and executed by the coaches they hire. They are not unbiased arbiters of the truth.
The presidents of @Harvard, @MIT, and @Penn were all asked the following question under oath at today’s congressional hearing on antisemitism:
Does calling for the genocide of Jews violate [your university’s] code of conduct or rules regarding bullying or harassment?
The answers they gave reflect the profound moral bankruptcy of Presidents Gay, Magill and Kornbluth.
Representative @EliseStefanik was so shocked with the answers that she asked each of them the same question over and over again, and they gave the same answers over and over again.
In short, they said:
It ‘depends on the context’ and ‘whether the speech turns into conduct,’ that is, actually killing Jews.
This could be the most extraordinary testimony ever elicited in the Congress, certainly on the topic of genocide, which to remind us all is:
“the deliberate killing of a large number of people from a particular nation or ethnic group with the aim of destroying that nation or group”
The presidents’ answers reflect the profound educational, moral and ethical failures that pervade certain of our elite educational institutions due in large part to their failed leadership.
Don’t take my word for it.
You must watch the following three minutes. By the end, you will be where I am.
They must all resign in disgrace.
If a CEO of one of our companies gave a similar answer, he or she would be toast within the hour.
Why has antisemitism exploded on campus and around the world?
Because of leaders like Presidents Gay, Magill and Kornbluth who believe genocide depends on the context.
To think that these are the leaders of Ivy League institutions that are charged with the responsibility to educate our best and brightest.
On the bright side, our congressional leaders deserve accolades for showing tremendous leadership and moral clarity in their statements, by the questions they asked, and the respectfulness with which they conducted the hearing.
It was a masterclass of how our government and democracy should operate.
If you have time, please watch the entire hearing. Throughout the hearing, the three behaved like hostile witnesses, exhibiting a profound disdain for the Congress with their smiles and smirks, and their outright refusal to answer basic questions with a yes or no answer.
If the election outcome is as I expected, it should cause the large minority of the country who supported @KamalaHarris and predicted her victory to begin to question their sources of truth.
Half the country has believed that @X is filled with mis- and disinformation, and that they could only therefore rely on The NY Times, MSNBC, CNN and other mainstream media for their news. And they did.
If, however, you have been active on @X for the last year, you have known the truth days, weeks and often months before the facts appear in the MSM.
The MSM excerpted, clipped and cut to defame @realDonaldTrump while claiming that @JoeBiden was fit as a fiddle. Then when Biden’s polls collapsed, @KamalaHarris was anointed the candidate and her hagiography was written with glowing acclaim from the press. But this could not hold as she ducked the media and held fast to the teleprompter.
Citizen journalists with their phone cameras in hand captured the real Kamala forcing her to defend her record and her plans in more media appearances. It did not go well and the public demanded to learn more so @KamalaHarris had to risk more unscripted media.
The doom loop was underway with perhaps 60 Minutes as one of the more dramatic examples, even after CBS tried to save her, most glaringly by excerpting one answer to replace a word salad response to another. But the citizen journalists on @X quickly caught and outed this fraud and demanded a transcript.
As many who supported Kamala began to realize that they have been misled, they became open to Trump as an alternative, but they didn’t want to rely on the media to understand him because they did not want to be misled again.
They wanted to hear the candidate in his own words and that is where @lexfridman and @joeroganhq long form podcasts came to the rescue. When Kamala was offered the same opportunities to explain herself, she rejected them. And the voting public could only draw a negative inference.
When the story of this election is written, I expect it will be as much about how half of America woke up to the reality that they have been manipulated by the media. This should lead to an abandonment by many of the MSM as their primary source of information. It will push more people to @X, to podcasts and other empirical sources, and it will lead to a more informed public.
The other outcome I hope happens is the implosion of the Democratic Party. The Party lied to the American people about the cognitive health and fitness of the president. It prevented, threatened, litigated and otherwise eliminated the ability of other candidates for the primary to compete, to get on ballots, and to even participate in a debate. The Party and the administration used lawfare in an attempt to imprison, bankrupt or otherwise kill off Trump as a candidate. These acts are collectively grave threats to our democracy. With the highest irony in order to hide these acts, the Party accused the opposition candidate of being the grave threat to democracy.
The Democratic Party proved itself to be fundamentally undemocratic. It needs a complete reboot. The leadership should be thrown out and those responsible should apologize to the American people.
Honest Abe said it best:
You can fool some of the people all of the time, and all of the people some of the time, but you can not fool all of the people all of the time.
A number of my good friends and family have been surprised about my decision to support @realDonaldTrump for president. They have been surprised because my political giving history has been mostly to Democrats, my voting registration has typically been Democrat (in NY, you must be registered to the party in order to vote in the primary, and usually the Republican candidate has no chance to win), and many of our philanthropic initiatives have supported issues that are consistent with Democratic priorities.
All of the above said, I have always considered myself to be a centrist and/or moderate, and I have voted for the candidate and supported the issues and policies that I believe are in the best interest of the country. Some have accused me of supporting Trump because doing so will somehow benefit me financially. Fortunately, I do not need any financial benefits as I and my family have well more than we need. I have also committed to give away the substantial majority of my resources at or by the time I am no longer, so I don't consider personal financial benefits in the determination of whom I support for office.
Some have suggested that I am supporting Trump because I am seeking a position in his administration. To be clear, I haven't been offered one and I wouldn't take a job in the administration (I love my job and it is the wrong time in my life to work in an administration). I will, however, do everything else I can to help the president succeed in helping our country and its citizens.
All of the above said, I am an investor who manages funds that own some of the best, principally American, businesses in the world. In a better governed and managed America, these business will do better and increase in value faster. One might therefore argue that being 'long' America is somehow a conflict, so I thought to disclose this potential 'conflict' here.
Some of my friends and family who support @KamalaHarris are ok with my supporting Trump, but don't want me to attempt to convince others to support him. Because I strongly believe that a Trump administration will be better for the country and the world than a Harris administration, I think it is important to share my thinking to the extent it helps others come to the right conclusion.

While the 33 actions I describe below are those of the Democratic Party and the Biden/Harris administration, they are also the actions and policies that unfortunately our most aggressive adversaries would likely implement if they wanted to destroy America from within, and had the ability to take control of our leadership.
These are the 33:
(1) open the borders to millions of immigrants who were not screened for their risk to the country, dumping them into communities where the new immigrants overwhelm existing communities and the infrastructure to support the new entrants, at the expense of the historic residents,
(2) introduce economic policies and massively increase spending without regard to their impact on inflation and the consequences for low-income Americans and the increase in our deficit and national debt,
(3) withdraw from Afghanistan, abandoning our local partners and the civilians who worked alongside us in an unprepared, overnight withdrawal that led to American casualties and destroyed the lives of Afghani women and girls for generations, against the strong advice of our military leadership, and thereafter not showing appropriate respect for their loss at a memorial ceremony in their honor,
(4) introduce thousands of new and unnecessary regulations in light of the existing regulatory regime that interfere with our businesses’ ability to compete, restraining the development of desperately needed housing, infrastructure, and energy production with the associated inflationary effects,
(5) modify the bail system so that violent criminals are released without bail,
(6) destroy our street retailers and communities and promote lawlessness by making shoplifting (except above large thresholds) no longer a criminal offense,
(7) limit and/or attempt to limit or ban fracking and LNG so that U.S. energy costs increase substantially and the U.S. loses its energy independence,
(8) promote DEI ideologies that award jobs, awards, and university admissions on the basis of race, sexual identity and gender criteria, and teach our students and citizens that the world can only be understood as an unfair battle between oppressors and the oppressed, where the oppressors are only successful due to structural racism or a rigged system and the oppressed are simply victims of an unfair system and world,
(9) educate our elementary children that gender is fluid, something to be chosen by a child, and promote hormone blockers and gender reassignment surgeries to our youth without regard to the longer-term consequences to their mental and physical health, and allow biological boys and men to compete in girls and women's sports, depriving girls and women of scholarships, awards, and other opportunities that they would have rightly earned otherwise,
(10) encourage and celebrate massive protests and riots that lead to the burning and destruction of local retail and business establishments while at the same time requiring schools to be shuttered because of the risk of Covid-19 spreading during large gatherings,
(11) encourage and celebrate anti-American and anti-Israel protests and flag burning on campuses around the country with no consequences for the protesters who violate laws or university codes and policies,
(12) allow antisemitism to explode with no serious efforts from the administration to quell this hatred,
(13) mandate vaccines that have not been adequately tested nor have their risks been properly considered compared with the potential benefits adjusted for the age and health of the individual, censoring the contrary advice of top scientists around the world,
(14) shut down free speech in media and on social media platforms that is inconsistent with government policies and objectives,
(15) use the U.S., state, and local legal systems to attack and attempt to jail, take off the campaign trail, and/or massively fine candidates for the presidency without regard to the merits or precedential issues of the case,
(16) seek to defund the police and promote anti-police rhetoric causing a loss of confidence in those who are charged with protecting us,
(17) use government funds to subsidize auto companies and internet providers with vastly more expensive, dated and/or lower-quality technology when greatly superior and cheaper alternatives are available from companies that are owned and/or managed by individuals not favored by the current administration,
(18) mandate in legislation and otherwise government solutions to problems when the private sector can do a vastly better, faster, and cheaper job,
(19) seek to ban gas-powered cars and stoves without regard to the economic and practical consequences of doing so,
(20) take no serious actions when 45 American citizens are killed by terrorists and 12 are taken hostage,
(21) hold back armaments and weaponry from our most important ally in the Middle East in the midst of their hostage negotiations, hostages who include American citizens who have now been held for more than one year,
(22) eliminate sanctions on one of our most dangerous enemies enabling them to generate $150 billion+ of cash reserves from oil sales, which they can then use to fund terrorist proxy organizations who attack us and our allies. Exchange five American hostages held by Iran for five Iranians plus $6 billion of cash in the worst hostage negotiation in history setting a disastrous and dangerous precedent,
(23) remove known terrorist organizations from the terrorist list so we can provide aid to their people, and allow them to shoot rockets at U.S. assets and military bases with little if any military response from us,
(24) lie to the American people about the cognitive health of the president and accuse those who provide video evidence of his decline of sharing doctored videos and being right wing conspirators,
(25) do nothing about the deteriorating health of our citizens driven by the food industrial complex, the fraudulent USDA food pyramid, and the inclusion of ingredients in our food that are banned by other countries around the world which are more protective of their citizens,
(26) do nothing about the proliferation of new vaccines that are not properly analyzed for their risk versus the potential benefit for healthy children who are mandated to receive them,
(27) do nothing about the continued exemption from liability for the pharma industry that has led to a proliferation of mandatory vaccines for children without considering the potential cumulative effects of the now mandated 72-shot regime,
(28) convince our minority youth that they are victims of a rigged system and that the American dream is not available to them,
(29) fail to provide adequate Secret Service protection for alternative presidential candidates,
(30) litigate to prevent alternative candidates from getting on the ballot, and take other anti-competitive steps including threatening political consultants who wish to work for alternative candidates for the presidency, and limit the potential media access for other candidates by threatening the networks' future access to the administration and access to 'scoops' if they platform an alternative candidate,
(31) select the Democratic nominee for president in a backroom process by undisclosed party leaders without allowing Americans to choose between candidates in an open primary,
(32) choose an inferior candidate for the presidency when other much more qualified candidates are available and interested to serve,
(33) litigate to make it illegal for states to require proof of citizenship, voter ID, and/or residence in order to vote at a time when many Americans have lost confidence in the accuracy and trustworthiness of our voting system.

The parade was great. Our military is incredible. And now @Israel needs our help to destroy Iran’s nuclear threat to the world.
Israel’s military and air force have sufficiently degraded Iran’s defenses such that this is now the lowest-risk, highest-probability moment to take out Iran’s nuclear capability, a grave threat to us all.
We should not let this opportunity pass, but Israel does not have the equipment and armaments to complete the job. We do, and it does not require boots on the ground.
The war Israel has been fighting has been on behalf of all of us. Let’s help them finish the job.
This afternoon @RealCandaceO slandered me by accusing me of 'staging an intervention' with Charlie Kirk in which 'threats were made' with respect to his supposed 'evolving stance' on Israel at an event I hosted in the Hamptons. Candace also intimated that I 'blackmail[ed]' Charlie.
On the show, Candace said that she 'would be very happy for me to dispute this narrative.' While it pains me to drive more traffic to her program, I am responding here to clear my name. It saddens me that we live in a society where social media influencers seek to monetize the tragic death of Charlie Kirk.
For the record, at no time have I ever threatened Charlie Kirk, Turning Point or anyone associated with him. I have never blackmailed anyone, let alone Charlie Kirk. I have never offered Charlie or Turning Point any money in an attempt to influence Charlie's opinion on anything. In fact, my interactions with Charlie Kirk have been extremely cordial, albeit limited, regretfully so, as I was very impressed by him and his work and I will sadly never see him again.
In an effort to clear the record, I share the following:
I have followed @charliekirk11 on @X for some time and greatly admired him. While I didn't agree with Charlie on every issue, I had enormous respect for his intelligence, vast knowledge about religion, and his willingness to take on all comers in open mic sessions on campus and otherwise. Periodically, I would repost some of his posts and video clips.
I connected with Charlie when he DM'd me in late May of this year and expressed interest in meeting me. In light of our respective schedules, we were unable to find a time to meet in person so we scheduled a zoom on June 11th.
On the zoom, he explained to me that conservatives, in particular, young conservatives were getting tired of defending Israel, and this was very concerning to him. I asked him how I could learn more, and he suggested that it might be useful to convene a group of young conservative influencers on a host of topics that could include Israel to get a better sense of how the conservative community was thinking about Israel and other relevant issues of concern to young people.
On the zoom, Charlie also said that his open mic conversations on campus were very effective in addressing issues on the minds of students, but he was only one person with limited bandwidth. He suggested that recruiting a group of junior Charlie Kirk's who could host open mic sessions on college campuses would be an effective way to encourage debate on a host of issues, an approach he believed to be worthy of consideration, and better enable students to get to the truth.
I expressed interest in learning more and we thereafter scheduled a series of conference calls and zooms with Charlie, Turning Point staff and members of my team in an effort to assemble a diverse group of influencers who we could convene for a day and a half session. In addition to getting a better sense of what and where young conservatives were on various issues, Charlie thought doing so might enable him to identify potential candidates who could launch their own campus tours and carry forth his approach to dialogue.
We chose the afternoon of August 4th to the afternoon of the 5th for the convening, and Charlie and members of my team worked to put together an invitation list. I offered to host the sessions in Bridgehampton (and cover the costs) so that I could attend some of the sessions as I was working from there at that time.
Charlie sent out the invitations and about 35 or so influencers accepted. Charlie estimated that the influencers who attended collectively had more than 100 million followers.
Charlie and Turning Point put together the agenda for the meeting and the topics were:
The Economic Future of America
The Cultural Landscape of Dating and Marriage
The Convergence of East and West
Mamdani, the New Threat to America
Charlie asked me to moderate the Economic Future discussion which I did, and I thereafter hosted a Q&A session with the participants.
The Convergence of East and West included a discussion of immigration, value systems, the U.S. approach to foreign policy and Israel. While I had wanted to attend the Convergence panel, I had a board meeting that conflicted with this session.
Those that attended this session said that the Israel discussion was similar to the other sessions with the attendees expressing varying points of view as well as explaining the views of their followers. Some participants were critical of Israel and U.S. support for Israel, and others were supportive.
The sessions were punctuated by meals. I attended one group lunch and a group dinner where I sat with Charlie and others.
I found the sessions I attended interesting and I really enjoyed meeting the influencers. It gave me considerable perspective on what is on the mind of young Americans on a wide range of issues.
At the end of the event, I sat with Charlie and members of my team and we discussed the events of the convening. Charlie believed that he had identified a number of potential Turning Point ambassadors who could launch open mic events on campus and that he would follow up with them. We agreed to keep in touch thereafter.
We corresponded by text thereafter over the next few weeks on a range of topics that did not include Israel, and the next thing I knew, he was gone.
In short, this was not an 'intervention' to 'blackmail' Charlie Kirk into adopting certain views on Israel. It was nothing of the sort.
The country is 100% behind the president on fixing a global system of tariffs that has disadvantaged the country. But, business is a confidence game and confidence depends on trust.
President @realDonaldTrump has elevated the tariff issue to the most important geopolitical issue in the world, and he has gotten everyone’s attention. So far, so good.
And yes, other nations have taken advantage of the U.S. by protecting their home industries at the expense of millions of our jobs and economic growth in our country.
But, by placing massive and disproportionate tariffs on our friends and our enemies alike and thereby launching a global economic war against the whole world at once, we are in the process of destroying confidence in our country as a trading partner, as a place to do business, and as a market to invest capital.
The president has an opportunity to call a 90-day time out, negotiate and resolve unfair asymmetric tariff deals, and induce trillions of dollars of new investment in our country.
If, on the other hand, on April 9th we launch economic nuclear war on every country in the world, business investment will grind to a halt, consumers will close their wallets and pocket books, and we will severely damage our reputation with the rest of the world that will take years and potentially decades to rehabilitate.
What CEO and what board of directors will be comfortable making large,
long-term, economic commitments in our country in the middle of an economic nuclear war?
I don’t know of one who will do so.
When markets crash, new investment stops, consumers stop spending money, and businesses have no choice but to curtail investment and fire workers.
And it is not just the big companies that will suffer. Small and medium size businesses and entrepreneurs will experience much greater pain. Almost no business can pass through an overnight massive increase in costs to their customers. And that’s true even if they have no debt, and, unfortunately, there is a massive amount of leverage in the system.
Business is a confidence game. The president is losing the confidence of business leaders around the globe. The consequences for our country and the millions of our citizens who have supported the president — in particular low-income consumers who are already under a huge amount of economic stress — are going to be severely negative. This is not what we voted for.
The President has an opportunity on Monday to call a time out and have the time to execute on fixing an unfair tariff system.
Alternatively, we are heading for a self-induced, economic nuclear winter, and we should start hunkering down.
May cooler heads prevail.
I am reaching out to the @X community for advice with the likely risk of sharing TMI. I have been sufficiently upset about the whole matter that I have lost sleep thinking about it and I am hoping that this post will enable me to get this matter off my chest.
By way of background, I started a family office called TABLE about 15 years ago and hired a friend who had previously managed a family office, and years earlier, had been my personal accountant. She is someone that I trusted implicitly and consider to be a good person.
The office started small, but over the last decade, the number of personnel and the cost of the office grew massively. The growth was entirely on the operational side as the investment team has remained tiny. While my investment portfolio grew substantially, the investments I had made were almost entirely passive and TABLE simply needed to account for them and meet capital calls as they came in. While TABLE purchased additional software and other systems that were supposed to improve productivity, the team kept increasing in size at a rapid rate, and the expenses continued to grow even faster.
While I would periodically question the growing expenses and high staff turnover, I stayed uninvolved with the office other than a once-a-year meeting when I briefly reviewed the operations and the financials and determined bonus compensation for the President and the CFO. I spent no time with any of the other employees or the operations. The whole idea behind TABLE was that it would handle everything other than my day job so that I would have more time for my job and my family.
Over the last six years, expenses ballooned even further, employee turnover accelerated, and I became concerned that all was not well at TABLE. It was time for me to take a look at what was going on.
Nearly four years ago, I recruited my nephew who had recently graduated from Harvard and put him to work at Bremont, a British watchmaker, one of my only active personal investments to figure out the issues at the company and ultimately assist in executing a turnaround. He did a superb job.
When he returned from the UK late last year after a few years at Bremont, I asked him to help me figure out what was going on with TABLE. When I explained to TABLE’s president what he would be doing, she became incredibly defensive, which naturally made me more concerned.
My nephew went to work by first meeting with each employee to understand their roles at the company and to learn from them what ideas they had on how things could be improved. He got an earful.
Our first step in helping to turn around TABLE was a reduction in force including the president and about a third of the team, retaining excellent talent that had been desperate for new leadership.
Now here is where I need your advice.
All but one of the employees who were terminated acted professionally and were gracious on the way out (excluding the president who had a notice period in her contract, is currently still being paid, and with whom I have not yet had a discussion).
The highest compensated terminated employee other than the president, an in-house lawyer (let’s call her Ronda), told us that three months of severance was not enough and demanded two years’ severance despite having worked at the company for only two and one half years.
When I learned of Ronda's request for severance, I offered to speak with her to understand what she was thinking, but she refused to do so. A few days ago, we received a threatening letter from a Silicon Valley law firm.
In the letter, Ronda’s counsel suggests that her termination is part of longstanding issues of ‘harassment and gender discrimination’ – an interesting claim in light of the fact that Ronda was in charge of workplace compliance – and that her termination was due to:
“unlawful, retaliatory, and harmful conduct directed towards her. Both [Ronda] and I [Ronda’s lawyer] have spoken with you about [Ronda’s] view of what a reasonable resolution would include given the circumstances. Thus far, TABLE has refused to provide any substantive response. This letter provides the last opportunity to reach a satisfactory agreement. If we cannot do so, [Ronda] will seek all appropriate relief in a court of competent jurisdiction.”
The letter goes on to explain the basis for the “unsafe work environment” claim at TABLE:
“In early 2026, Pershing Square’s founder Bill Ackman installed his nephew in an unidentified role at TABLE, Ackman’s family office. [His nephew]—whose only work experience had been for TABLE where he was seconded abroad for the last four years to a UK watch company held by Ackman—began appearing at TABLE’s offices and conducting interviews of employees without a clear explanation of his role or the purposes of these interviews. During this period, he made a series of inappropriate and genderbased [sic] comments to multiple employees that created an unsafe work environment. Among other things, [his nephew] made remarks about female employees’ ages (“Tell me you are nowhere near 40”), physical appearance (“Your body does not look like you have kids”), as well as intrusive questions about family planning and sexual orientation (“Who carried your son? Who will carry your next child?”). These incidents were reported to senior leadership at TABLE and Pershing Square. Rather than being addressed appropriately, the response from senior management reflected, at best, willful blindness to the inappropriateness of [his nephew]’s remarks and, at worst, tacit endorsement.”
The above allegations about my nephew had previously been brought to my attention by TABLE’s president when they occurred. When I learned of them, I told the president that I would speak to him directly and encouraged her to arrange for him to get workplace sensitivity training. The president assured me that she would do so.
When I spoke to my nephew, he explained what he actually had said and how his actual remarks had been received, not at all as alleged in the legal letter from Ronda’s counsel. I have also spoken to others at the lunch table who confirmed his description of the facts. In any case, he meant no harm, was simply trying to build rapport with other employees, and no one, as far as I understand, was offended.
Ironically, Ronda claims in her legal letter that TABLE didn’t take HR compliance seriously, yet Ronda was in charge of HR compliance at TABLE and the person who gave my nephew his workplace sensitivity training after the alleged incidents. In any case, Ronda, as head of compliance, should have kept a record or raised an alarm if indeed there was pervasive harassment or other such problems at the company, and there is no evidence whatsoever that this is true.
So why does Ronda believe she can get me to pay her nearly $2 million, i.e., two years of severance, nearly one year of severance for each of her years at the company? Well, here is where some more background would be helpful.
Over the last two months, I have been consumed with a major family medical issue – one of my older daughters had a massive brain hemorrhage on February 5th and has since been making progress on her recovery – and I am in the midst of a major transaction for my company which I am executing from a hospital room office next to her . While the latter business matter is publicly known, the details of my daughter’s situation are only known to Ronda because of her role at our family office.
Now, let’s get back to the subject at hand.
Unfortunately, while New York and many other states have employment-at-will, there has emerged an industry of lawyers who make a living from bringing fake gender, race, LGBTQ and other discrimination employment claims in order to extract larger severance payments for terminated employees, and it needs to stop.
The fake claim system succeeds because it costs little to have a lawyer send a threatening letter and nearly all of the lawyers in this field work on contingency so there is no or minimal cash cost to bring a claim. And inevitably, nearly 100% of these claims are settled because the public relations and legal costs of defending them exceed the dollar cost of the settlement. The claims are nearly always settled with a confidentiality agreement where the employee who asserts the fake claims remains anonymous and as a result, there is no reputational cost to bringing false claims.
The consequences of this sleazy system (let’s call it ‘the System’) are the increased costs of doing business which is a tax on the economy and society. There are other more serious problems due to the System. Unfortunately, the existence of an industry of plaintiff firms and terminated employees willing to make these claims makes it riskier for companies to hire employees from a protected class, i.e., LGBTQ, seniors, women, people of color etc. because it is that much more reputationally damaging and expensive to be accused of racism, sexism, and/or intolerance for sexual diversity than for firing a white male as juries generally have less sympathy for white males.
The System therefore increases the risk of discrimination rather than reducing it, and the people bringing these fake claims are thereby causing enormous harm to the other members of these protected classes.
So what happened here?
Ronda was vastly overpaid and overqualified for the job that she did at TABLE. She was paid $1.05 million plus benefits last year for her work which was largely comprised of filling out subscription agreements and overseeing an outside law firm on closing passive investments in funds and in private and venture stage companies, some compliance work, and managing the office move from one office to another. She had a very good gig as she was highly paid, only had to go into the office three days a week, and could work from anywhere during the summer.
Once my nephew showed up and started to investigate what was going on, she likely concluded that there was a reasonable possibility she would be terminated, as her job was in the too-easy-and-to-good-to-be-true category. The problem was that she was not in a protected class due to her race, age or sexual identity so she had to construct the basis for a claim. While she is female and could in theory bring a gender-based discrimination claim, she reported to the president who is female and to whom she is very close, which makes it difficult for her to bring a harassment claim against her former boss.
When my nephew complimented a TABLE employee at lunch about how young she looked – in response to saying she was going to her 40-year-old sister’s birthday party, he said ‘she must be your older sister’ – Ronda immediately reported it to our external HR lawyer. She thereby began building her case.
The other problem for Ronda bringing a claim is that she was terminated alongside 30% of other TABLE employees as part of a restructuring so it is very difficult for her to say that she was targeted in her termination or was retaliated against. TABLE is now hiring an external fractional general counsel as that is all the company needs to process the relatively limited amount of legal work we do internally. In short, Ronda was eminently qualified and capable and did her job. She was just too much horsepower for what is largely an administrative legal role so she had to come up with something else to bring a claim.
Now Ronda knew I was a good target and it was a good time to bring a claim against me. She also knew that I was under a lot of pressure because on March 4th when Ronda was terminated, my daughter had not yet emerged from consciousness, she was not yet breathing on her own, and my daughter and we were fighting for her life. I was and remain deeply engaged in her recovery while at the same time I was working on finishing the closing for the private placement round for my upcoming IPO.
Ronda also knew that publicity about supposed gender discrimination and a “hostile and unsafe work environment” are not things that a CEO of a company about to go public wants to have released into the media. And she may have thought that the nearly $2 million she was asking for would be considered small in the context of the reputational damage a lawsuit could cause, regardless of the fact that two years of severance was an absurd amount for an employee who had only worked at TABLE for 30 months.
She also likely considered that I wouldn’t want to embarrass my nephew by dragging him into the klieg lights when her claims emerged publicly.
So, in summary, game theory would say that I would certainly settle this case, for why would I risk negative publicity at a time when I was preparing our company to go public and also risk embarrassing my nephew.
Notably, she hired a Silicon Valley law firm, rather than a typical NY employment firm. This struck me as interesting as her husband works for one of the most prominent Silicon Valley venture firms whose CEO, I am sure, has no tolerance for these kinds of fake claims that sadly many venture-backed companies also have to deal with. I mention this as I suspect her husband likely has been working with her on the strategy for squeezing me as, in addition to being a computer scientist, he is a game theorist. My only advice for him is to understand more about your opponent before you launch your first move.
All of the above said, gender, race, LGBTQ and other such discrimination is a real thing. Many people have been harmed and deserve compensation for this discrimination, and these companies and individuals should be punished for engaging in such behavior.
Which brings me to the advice I am seeking from the X community.
I am not planning to follow the typical path and settle this ‘claim.’ Rather, I am going to fight this nonsense to the end of the earth in the hope that it inspires other CEOs to do the same so we shut down this despicable behavior that is a large tax on society, employment, and the economy and contributes to workplace discrimination rather than reducing it.

And they did. \n\nIf, however, you have been active on @X for the last year, you have known the truth days, weeks and often months before the facts appear in the MSM.\n\nThe MSM excerpted, clipped and cut to defame @realDonaldTrump while claiming that @JoeBiden was fit as a fiddle. Then when Biden’s polls collapsed, @KamalaHarris was anointed the candidate and her hagiography was written with glowing acclaim from the press. But this could not hold as she ducked the media and held fast to the teleprompter. \n\nCitizen journalists with their phone cameras in hand captured the real Kamala forcing her to defend her record and her plans in more media appearances. It did not go well and the public demanded to learn more so @KamalaHarris had to risk more unscripted media. \n\nThe doom loop was underway with perhaps 60 Minutes as one of the more dramatic examples, even after CBS tried to save her, most glaringly by excerpting one answer to replace a word salad response to another. But the citizen journalists on @X quickly caught and outed this fraud and demanded a transcript. \n\nAs many who supported Kamala began to realize that they have been misled, they became open to Trump as an alternative, but they didn’t want to rely on the media to understand him because they did not want to be misled again. \n\nThey wanted to hear the candidate in his own words and that is where @lexfridman and @joeroganhq long form podcasts came to the rescue. When Kamala was offered the same opportunities to explain herself, she rejected them. And the voting public could only draw a negative inference. \n\nWhen the story of this election is written, I expect it will be as much about how half of America woke up to the reality that they have been manipulated by the media. This should lead to an abandonment by many of the MSM as their primary source of information. It will push more people to @X, to podcasts and other empirical sources, and it will lead to a more informed public. \n\nThe other outcome I hope happens is the implosion of the Democratic Party. The Party lied to the American people about the cognitive health and fitness of the president. It prevented, threatened, litigated and otherwise eliminated the ability of other candidates for the primary to compete, to get on ballots, and to even participate in a debate. The Party and the administration used lawfare in an attempt to imprison, bankrupt or otherwise kill off Trump as a candidate. These acts are collectively grave threats to our democracy. With the highest irony in order to hide these acts, the Party accused the opposition candidate of being the grave threat to democracy. \n\nThe Democratic Party proved itself to be fundamentally undemocratic. It needs a complete reboot. They have been surprised because my political giving history has been mostly to Democrats, my voting registration has typically been Democrat (in NY, you must be registered to the party in order to vote in the primary, and usually the Republican candidate has no chance to win), and many of our philanthropic initiatives have supported issues that are consistent with Democratic priorities.\n\nAll of the above said, I have always considered myself to be a centrist and/or moderate, and I have voted for the candidate and supported the issues and policies that I believe are in the best interest of the country. Some have accused me of supporting Trump because doing so will somehow benefit me financially. Fortunately, I do not need any financial benefits as I and my family have well more than we need. I have also committed to give away the substantial majority of my resources at or by the time I am no longer, so I don't consider personal financial benefits in the determination of whom I support for office. \n\nSome have suggested that I am supporting Trump because I am seeking a position in his administration. To be clear, I haven't been offered one and I wouldn't take a job in the administration (I love my job and it is the wrong time in my life to work in an administration). I will, however, do everything else I can to help the president succeed in helping our country and its citizens.\n\nAll of the above said, I am an investor who manages funds that own some of the best, principally American, businesses in the world. In a better governed and managed America, these business will do better and increase in value faster. where the new immigrants overwhelm existing communities and the infrastructure to support the new entrants, at the expense of the historic residents,\n\n(2) introduce economic policies and massively increase spending without regard to their impact on inflation and the consequences for low-income Americans and the increase in our deficit and national debt,\n\n(3) withdraw from Afghanistan, abandoning our local partners and the civilians who worked alongside us in an unprepared, overnight withdrawal that led to American casualties and destroyed the lives of Afghani women and girls for generations, against the strong advice of our military leadership, and thereafter not showing appropriate respect for their loss at a memorial ceremony in their honor,\n\n(4) introduce thousands of new and unnecessary regulations in light of the existing regulatory regime that interfere with our businesses’ ability to compete, restraining the development of desperately needed housing, infrastructure, and energy production with the associated inflationary effects,\n\n(5) modify the bail system so that violent criminals are released without bail,\n\n(6) destroy our street retailers and communities and promote lawlessness by making shoplifting (except above large thresholds) no longer a criminal offense,\n\n(7) limit and/or attempt to limit or ban fracking and LNG so that U.S. energy costs increase substantially and the U.S. loses its energy independence,\n\n(8) promote DEI ideologies that award jobs, awards, and university admissions on the basis of race, sexual identity and gender criteria, and teach our students and citizens that the world can only be understood as an unfair battle between oppressors and the oppressed, where the oppressors are only successful due to structural racism or a rigged system and the oppressed are simply victims of an unfair system and world,\n\n(9) educate our elementary children that gender is fluid, something to be chosen by a child, and promote hormone blockers and gender reassignment surgeries to our youth without regard to the longer-term consequences to their mental and physical health, and allow biological boys and men to compete in girls and women's sports, depriving girls and women of scholarships, awards, and other opportunities that they would have rightly earned otherwise,\n\n(10) encourage and celebrate massive protests and riots that lead to the burning and destruction of local retail and business establishments while at the same time requiring schools to be shuttered because of the risk of Covid-19 spreading during large gatherings,\n\n(11) encourage and celebrate anti-American and anti-Israel protests and flag burning on campuses around the country with no consequences for the protesters who violate laws or university codes and policies,\n\n(12) allow antisemitism to explode with no serious efforts from the administration to quell this hatred,\n\n(13) mandate vaccines that have not been adequately tested nor have their risks been properly considered compared with the potential benefits adjusted for the age and health of the individual, censoring the contrary advice of top scientists around the world,\n\n(14) shut down free speech in media and on social media platforms that is inconsistent with government policies and objectives,\n\n(15) use the U.S., state, and local legal systems to attack and attempt to jail, take off the campaign trail, and/or massively fine candidates for the presidency without regard to the merits or precedential issues of the case,\n\n(16) seek to defund the police and promote anti-police rhetoric causing a loss of confidence in those who are charged with protecting us,\n\n(17) use government funds to subsidize auto companies and internet providers with vastly more expensive, dated and/or lower-quality technology when greatly superior and cheaper alternatives are available from companies that are owned and/or managed by individuals not favored by the current administration,\n\n(18) mandate in legislation and otherwise government solutions to problems when the private sector can do a vastly better, faster, and cheaper job,\n\n(19) seek to ban gas-powered cars and stoves without regard to the economic and practical consequences of doing so,\n\n(20) take no serious actions when 45 American citizens are killed by terrorists and 12 are taken hostage,\n\n(21) hold back armaments and weaponry from our most important ally in the Middle East in the midst of their hostage negotiations, hostages who include American citizens who have now been held for more than one year,\n\n(22) eliminate sanctions on one of our most dangerous enemies enabling them to generate $150 billion+ of cash reserves from oil sales, which they can then use to fund terrorist proxy organizations who attack us and our allies. new and unnecessary regulations in light of the existing regulatory regime that interfere with our businesses’ ability to compete, restraining the development of desperately needed housing, infrastructure, and energy production with the associated inflationary effects,\n\n(5) modify the bail system so that violent criminals are released without bail,\n\n(6) destroy our street retailers and communities and promote lawlessness by making shoplifting (except above large thresholds) no longer a criminal offense,\n\n(7) limit and/or attempt to limit or ban fracking and LNG so that U.S. energy costs increase substantially and the U.S. loses its energy independence,\n\n(8) promote DEI ideologies that award jobs, awards, and university admissions on the basis of race, sexual identity and gender criteria, and teach our students and citizens that the world can only be understood as an unfair battle between oppressors and the oppressed, where the oppressors are only successful due to structural racism or a rigged system and the oppressed are simply victims of an unfair system and world,\n\n(9) educate our elementary children that gender is fluid, something to be chosen by a child, and promote hormone blockers and gender reassignment surgeries to our youth without regard to the longer-term consequences to their mental and physical health, and allow biological boys and men to compete in girls and women's sports, depriving girls and women of scholarships, awards, and other opportunities that they would have rightly earned otherwise,\n\n(10) encourage and celebrate massive protests and riots that lead to the burning and destruction of local retail and business establishments while at the same time requiring schools to be shuttered because of the risk of Covid-19 spreading during large gatherings,\n\n(11) encourage and celebrate anti-American and anti-Israel protests and flag burning on campuses around the country with no consequences for the protesters who systems to attack and attempt to jail, take off the campaign trail, and/or massively fine candidates for the presidency without regard to the merits or precedential issues of the case,\n\n(16) seek to defund the police and promote anti-police rhetoric causing a loss of confidence in those who are charged with protecting us,\n\n(17) use government funds to subsidize auto companies and internet providers with vastly more expensive, dated and/or lower-quality technology when greatly superior and cheaper alternatives are available from companies that are owned and/or managed by individuals not favored by the current administration,\n\n(18) mandate in legislation and otherwise government solutions to problems when the private sector can do a vastly better, faster, and cheaper job,\n\n(19) seek to ban gas-powered cars and stoves without regard to the economic and practical consequences of doing so,\n\n(20) take no serious actions when 45 American citizens are killed by terrorists and 12 are taken hostage,\n\n(21) hold back armaments and weaponry from our most important ally in the Middle East in the midst of their hostage negotiations, hostages who include American citizens who have to fund terrorist proxy organizations who attack us and our allies. Candace also intimated that I 'blackmail[ed]' Charlie.\n\nOn the show, Candace said that she 'would be very happy for me to dispute this narrative.' While it pains me to drive more traffic to her program, I am responding here to clear my name. It saddens me that we live in a society where social media influencers seek to monetize the tragic death of Charlie Kirk.\n\nFor the record, at no time have I ever threatened Charlie Kirk, Turning Point or anyone associated with him. I have never blackmailed anyone, let alone Charlie Kirk. I have never offered Charlie or Turning Point any money in an attempt to influence Charlie's opinion on anything. In fact, my interactions with Charlie Kirk have been extremely cordial, albeit limited, regretfully so, as I was very impressed by him and his work and I will sadly never see him again.\n\nIn an effort to clear the record, I share the following:\n\nI have followed @charliekirk11 on @X for some time and greatly admired him. While I didn't agree with Charlie on every issue, I had enormous respect for his intelligence, vast knowledge about religion, and his willingness to take on all comers in open mic sessions on campus and otherwise. Periodically, I would repost some of his posts and video clips.\n\nI connected with Charlie when he DM'd me in late May of this year and expressed interest in meeting me. In light of our respective schedules, we were unable to find a time to meet in person so we scheduled a zoom on June 11th.\n\nOn the zoom, he explained to me that conservatives, in particular, young conservatives were getting tired of defending Israel, and this was very concerning to him. I asked him how I could learn more, and he suggested that it might be useful to convene a group of young conservative influencers on a host of topics that could include Israel to get a better sense of how the conservative community was thinking about Israel and other relevant issues of concern to young people.\n\nOn the zoom, Charlie also said that his open mic conversations on campus were very effective in addressing issues on the minds of students, but he was only one person with limited bandwidth. He suggested that recruiting a group of junior Charlie Kirk's who could host open mic sessions on college campuses would be an effective way to encourage debate on a host of issues, an approach he believed to be worthy of consideration, and better enable students to get to the truth.\n\nI expressed interest in learning more and we thereafter scheduled a series of conference calls and zooms with Charlie, Turning Point staff and members of my team in an effort to assemble a diverse group of influencers who we could convene for a day and a half session. In addition to getting a better sense of what and where young conservatives were on various issues, Charlie thought doing so might enable him to identify potential candidates who could launch their own campus tours and carry forth his approach to dialogue.\n\nWe chose the afternoon of August 4th to the afternoon of the 5th for the convening, and Charlie and members of my team worked to put together an invitation list. I offered to host the sessions in Bridgehampton (and cover the costs) so that I could attend some of the sessions as I was working from there at that time.\n\nCharlie sent out the invitations and about 35 or so influencers accepted. Charlie estimated that the influencers who attended collectively had more than 100 million followers.\n\nCharlie and Turning Point put together the agenda for the meeting and the topics were:\n\nThe Economic Future of America\nThe Cultural Landscape of Dating and Marriage\nThe Convergence of East and West\nMamdani, the New Threat to America\n\nCharlie asked me to moderate the Economic Future discussion which I did, and I thereafter hosted a Q&A session with the participants.\n\nThe Convergence of East and West included a discussion of immigration, value systems, the U.S. approach to foreign policy and Israel. While I had wanted to attend the Convergence panel, I had a board meeting that conflicted with this session.\n\nThose that attended this session said that the Israel discussion was similar to the other sessions with the attendees expressing varying points of view as well as explaining the views of their followers. Some participants were critical of Israel and U.S. support for Israel, and others were supportive. \n\nThe sessions were punctuated by meals. I attended one group lunch and a group dinner where I sat with Charlie and others.\n\nI found the sessions I attended interesting and I really enjoyed meeting the influencers. It gave me considerable perspective on what is on the mind of young Americans on a wide range of issues.\n\nAt the end of the event, I sat with Charlie and members of my team and we discussed the events of the convening. Charlie believed that he had identified a number of potential Turning Point ambassadors who could launch open mic events on campus and that he would follow up with them. We agreed to keep in touch thereafter.\n\nWe corresponded by text thereafter over the next few weeks on a range of topics that did not include Israel, and the next thing I knew, he was gone.\n\nIn short, this was not an 'intervention' to 'blackmail' Charlie Kirk into adopting certain views on Israel. I have been sufficiently upset about the whole matter that I have lost sleep thinking about it and I am hoping that this post will enable me to get this matter off my chest.\n\nBy way of background, I started a family office called TABLE about 15 years ago and hired a friend who had previously managed a family office, and years earlier, had been my personal accountant. She is someone that I trusted implicitly and consider to be a good person.\n\nThe office started small, but over the last decade, the number of personnel and the cost of the office grew massively. The growth was entirely on the operational side as the investment team has remained tiny. While my investment portfolio grew substantially, the investments I had made were almost entirely passive and TABLE simply needed to account for them and meet capital calls as they came in. While TABLE purchased additional software and other systems that were supposed to improve productivity, the team kept increasing in size at a rapid rate, and the expenses continued to grow even faster.\n\nWhile I would periodically question the growing expenses and high staff turnover, I stayed uninvolved with the office other than a once-a-year meeting when I briefly reviewed the operations and the financials and determined bonus compensation for the President and the CFO. I spent no time with any of the other employees or the operations. The whole idea behind TABLE was that it would handle everything other than my day job so that I would have more time for my job and my family.\n\nOver the last six years, expenses ballooned even further, employee turnover accelerated, and I became concerned that all was not well at TABLE. It was time for me to take a look at what was going on.\n\nNearly four years ago, I recruited my nephew who had recently graduated from Harvard and put him to work at Bremont, a British watchmaker, one of my only active personal investments to figure out the issues at the company and ultimately assist in executing a turnaround. He did a superb job.\n\nWhen he returned from the UK late last year after a few years at Bremont, I asked him to help me figure out what was going on with TABLE. When I explained to TABLE’s president what he would be doing, she became incredibly defensive, which naturally made me more concerned.\n\nMy nephew went to work by first meeting with each employee to understand their roles at the company and to learn from them what ideas they had on how things could be improved. He got an earful.\n\nOur first step in helping to turn around TABLE was a reduction in force including the president and about a third of the team, retaining excellent talent that had been desperate for new leadership.\n\nNow here is where I need your advice.\n\nAll but one of the employees who were terminated acted professionally and were gracious on the way out (excluding the president who had a notice period in her contract, is currently still being paid, and with whom I have not yet had a discussion). \n\nThe highest compensated terminated employee other than the president, an in-house lawyer (let’s call her Ronda), told us that three months of severance was not enough and demanded two years’ severance despite having worked at the company for only two and one half years.\n\nWhen I learned of Ronda's request for severance, I offered to speak with her to understand what she was thinking, but she refused to do so. A few days ago, we received a threatening letter from a Silicon Valley law firm.\n\nIn the letter, Ronda’s counsel suggests that her termination is part of longstanding issues of ‘harassment and gender discrimination’ – an interesting claim in light of the fact that Ronda was in charge of workplace compliance – and that her termination was due to:\n\n“unlawful, retaliatory, and harmful conduct directed towards her. Both [Ronda] and I [Ronda’s lawyer] have spoken with you about [Ronda’s] view of what a reasonable resolution would include given the circumstances. Thus far, TABLE has refused to provide any substantive response. This letter provides the last opportunity to reach a satisfactory agreement. If we cannot do so, [Ronda] will seek all appropriate relief in a court of competent jurisdiction.”\n\nThe letter goes on to explain the basis for the “unsafe work environment” claim at TABLE:\n\n“In early 2026, Pershing Square’s founder Bill Ackman installed his nephew in an unidentified role at TABLE, Ackman’s family office. [His nephew]—whose only work experience had been for TABLE where he was seconded abroad for the last four years to a UK watch company held by Ackman—began appearing at TABLE’s offices and conducting interviews of employees without a clear explanation of his role or the purposes of these interviews. During this period, he made a series of inappropriate and genderbased [sic] comments to multiple employees that created an unsafe work environment. Among other things, [his nephew] made remarks about female employees’ ages (“Tell me you are nowhere near 40”), physical appearance (“Your body does not look like you have kids”), as well as intrusive questions about family planning and sexual orientation (“Who carried your son? Who will carry your next child?”). These incidents were reported to senior leadership at TABLE and Pershing Square. Rather than being addressed appropriately, the response from senior management reflected, at best, willful blindness to the inappropriateness of [his nephew]’s remarks and, at worst, tacit endorsement.”\n\nThe above allegations about my nephew had previously been brought to my attention by TABLE’s president when they occurred. When I learned of them, I told the president that I would speak to him directly and encouraged her to arrange for him to get workplace sensitivity training. The president assured me that she would do so.\n\nWhen I spoke to my nephew, he explained what he actually had said and how his actual remarks had been received, not at all as alleged in the legal letter from Ronda’s counsel. I have also spoken to others at the lunch table who confirmed his description of the facts. In any case, he meant no harm, was simply trying to build rapport with other employees, and no one, as far as I understand, was offended. \n\nIronically, Ronda claims in her legal letter that TABLE didn’t take HR compliance seriously, yet Ronda was in charge of HR compliance at TABLE and the person who gave my nephew his workplace sensitivity training after the alleged incidents. In any case, Ronda, as head of compliance, should have kept a record or raised an alarm if indeed there was pervasive harassment or other such problems at the company, and there is no evidence whatsoever that this is true.\n\nSo why does Ronda believe she can get me to pay her nearly $2 million, i.e., two years of severance, nearly one year of severance for each of her years at the company? Well, here is where some more background would be helpful.\n\nOver the last two months, I have been consumed with a major family medical issue – one of my older daughters had a massive brain hemorrhage on February 5th and has since been making progress on her recovery – and I am in the midst of a major transaction for my company which I am executing from a hospital room office next to her . While the latter business matter is publicly known, the details of my daughter’s situation are only known to Ronda because of her role at our family office.\n\nNow, let’s get back to the subject at hand.\n\nUnfortunately, while New York and many other states have employment-at-will, there has emerged an industry of lawyers who make a living from bringing fake gender, race, LGBTQ and other discrimination employment claims in order to extract larger severance payments for terminated employees, and it needs to stop.\n\nThe fake claim system succeeds because it costs little to have a lawyer send a threatening letter and nearly all of the lawyers in this field work on contingency so there is no or minimal cash cost to bring a claim. And inevitably, nearly 100% of these claims are settled because the public relations and legal costs of defending them exceed the dollar cost of the settlement. The claims are nearly always settled with a confidentiality agreement where the employee who asserts the fake claims remains anonymous and as a result, there is no reputational cost to bringing false claims.\n\nThe consequences of this sleazy system (let’s call it ‘the System’) are the increased costs of doing business which is a tax on the economy and society. There are other more serious problems due to the System. Unfortunately, the existence of an industry of plaintiff firms and terminated employees willing to make these claims makes it riskier for companies to hire employees from a protected class, i.e., LGBTQ, seniors, women, people of color etc. because it is that much more reputationally damaging and expensive to be accused of racism, sexism, and/or intolerance for sexual diversity than for firing a white male as juries generally have less sympathy for white males. \n\nThe System therefore increases the risk of discrimination rather than reducing it, and the people bringing these fake claims are thereby causing enormous harm to the other members of these protected classes.\n\nSo what happened here?\n\nRonda was vastly overpaid and overqualified for the job that she did at TABLE. She was paid $1.05 million plus benefits last year for her work which was largely comprised of filling out subscription agreements and overseeing an outside law firm on closing passive investments in funds and in private and venture stage companies, some compliance work, and managing the office move from one office to another. She had a very good gig as she was highly paid, only had to go into the office three days a week, and could work from anywhere during the summer.\n\nOnce my nephew showed up and started to investigate what was going on, she likely concluded that there was a reasonable possibility she would be terminated, as her job was in the too-easy-and-to-good-to-be-true category. The problem was that she was not in a protected class due to her race, age or sexual identity so she had to construct the basis for a claim. While she is female and could in theory bring a gender-based discrimination claim, she reported to the president who is female and to whom she is very close, which makes it difficult for her to bring a harassment claim against her former boss.\n\nWhen my nephew complimented a TABLE employee at lunch about how young she looked – in response to saying she was going to her 40-year-old sister’s birthday party, he said ‘she must be your older sister’ – Ronda immediately reported it to our external HR lawyer. She thereby began building her case.\n\nThe other problem for Ronda bringing a claim is that she was terminated alongside 30% of other TABLE employees as part of a restructuring so it is very difficult for her to say that she was targeted in her termination or was retaliated against. TABLE is now hiring an external fractional general counsel as that is all the company needs to process the relatively limited amount of legal work we do internally. In short, Ronda was eminently qualified and capable and did her job. She was just too much horsepower for what is largely an administrative legal role so she had to come up with something else to bring a claim.\n\nNow Ronda knew I was a good target and it was a good time to bring a claim against me. She also knew that I was under a lot of pressure because on March 4th when Ronda was terminated, my daughter had not yet emerged from consciousness, she was not yet breathing on her own, and my daughter and we were fighting for her life. I was and remain deeply engaged in her recovery while at the same time I was working on finishing the closing for the private placement round for my upcoming IPO.\n\nRonda also knew that publicity about supposed gender discrimination and a “hostile and unsafe work environment” are not things that a CEO of a company about to go public wants to have released into the media. And she may have thought that the nearly $2 million she was asking for would be considered small in the context of the reputational damage a lawsuit could cause, regardless of the fact that two years of severance was an absurd amount for an employee who had only worked at TABLE for 30 months.\n\nShe also likely considered that I wouldn’t want to embarrass my nephew by dragging him into the klieg lights when her claims emerged publicly. \n\nSo, in summary, game theory would say that I would certainly settle this case, for why would I risk negative publicity at a time when I was preparing our company to go public and also risk embarrassing my nephew.\n\nNotably, she hired a Silicon Valley law firm, rather than a typical NY employment firm. This struck me as interesting as her husband works for one of the most prominent Silicon Valley venture firms whose CEO, I am sure, has no tolerance for these kinds of fake claims that sadly many venture-backed companies also have to deal with. I mention this as I suspect her husband likely has been working with her on the strategy for squeezing me as, in addition to being a computer scientist, he is a game theorist. My only advice for him is to understand more about your opponent before you launch your first move.\n\nAll of the above said, gender, race, LGBTQ and other such discrimination is a real thing. Many people have been harmed and deserve compensation for this discrimination, and these companies and individuals should be punished for engaging in such behavior.\n\nWhich brings me to the advice I am seeking from the X community.\n\nI am not planning to follow the typical path and settle this ‘claim.’ Rather, I am going to fight this nonsense to the end of the earth in the hope that it inspires other CEOs to do the same so we shut down this despicable behavior that is a large tax on society, employment, and the economy and contributes to workplace discrimination rather than reducing
