For just the second time in its 179-year history, Scientific American is endorsing a candidate for president of the United States: Kamala Harris.

Alexander Hamilton wrote in Federalist 69 that former presidents would be “liable to prosecution and punishment in the ordinary course of law.” But what did he know? He was just a bastard, orphan, son of a whore and a Scotsman, dropped in the middle of a forgotten spot in the Caribbean. . .

The Harris/Walz wave continues to swell because it’s much more than just a blue wave. This is rapidly becoming America’s campaign, one without partisan boundaries!

Of the 6-Justice majority in today’s terrible immunity decision, two justices (Thomas, Alito) were violating federal law (28 USC 455) by not recusing from the case and three (Gorsuch, Kavanaugh, Barrett) were appointed by the man whom the decision essentially immunized. Hmmm. 🤔

Judge Cannon just did the unthinkable: She dismissed the Trump classified documents case on the repeatedly rejected basis that DOJ violated the Constitution’s Appointments Clause by appointing Special Counsel Smith at all! DOJ must appeal right away. On SCOTUS, only Justice Thomas took that view in Trump v. United States. This finally gives Jack Smith an opportunity to seek her removal from the case. I think the case for doing so is very strong.

Chevron is now overruled. The administrative state just died. The imperial judiciary joins the imperial presidency, relegating Congress to a secondary role except when it legislates with unrealistic specificity and foresight.

Women get it, but here’s a word to my male followers: imagine not being able to buy a condom, get a doctor to treat a genital illness, or seek care for your pregnant partner without triggering a police investigation or a search of your sexual history. That’s Trumplandia, guys.

The justices who were eager to invent a sphere of such immunity today weren’t deterred by such precedent or by logic. They’re shameless.

Not that anyone’s going to do anything about it, but it might be good to remember that, as an adjudicated oath-breaking insurrectionist, Mr.Trump is constitutionally disqualified under Sec. 3 of 14th Am from taking the oath as president on 1/20/25 unless 2/3 of both houses lift the disqualification

The ones I feel sorry for are my administrative law colleagues who built their courses and careers around the intricacies of Chevron deference.

The 1934 Firearms Act bans civilian ownership of a “machine gun,” defined as a weapon that can fire “automatically more than one shot, without manual reloading, by a single function of the trigger.” 26 U. S. C. §5845(b). A semi-automatic weapon requires the shooter to pull the trigger after each shot, but a weapon modified with a bump stock does not. “As long as the shooter keeps his trigger finger on the finger rest and maintains constant forward pressure on the rifle’s barrel or front grip, the weapon will fire continuously.” See 83 Fed. Reg. 66516. But six Justices who will soon have blood-soaked robes overrode the ATF’s common sense conclusion that keeping pressure on your trigger finger long enough for your gun to fire 13 times PER SECOND is a “single function” as Congress used that term. The fact that the six were taking aim at the administrative state and not at those whom the next crazed shooter will kill by firing 800 rounds per minute with each pull of his trigger finger may enable them to sleep at night, but it shouldn’t.
