What will all those who were defending ADANI say now? How will Safaricom explain to UK & South Africa regulators how it entered into multi- billion contracts with a crook without due diligence? Of course Kenya regulators approved all the transactions without any due diligence. We hope that one day, Kenya Regulatory bodies will truly abide by the law established & not bend to political whims! Day of reckoning will one day catch up with our Regulators. Once again, US saves Kenya from crooks!

Gen Z has given me hope that Kenya without TRIBALISM, CORRUPTION, NEPOTISM & CRONYISM is possible. A Kenya that values all her children over TRIBE, CREED, CLASS, GENDER & AGE. SUPREME COURT JUDGEMENT ON PUBLIC PARTICIPATION IS UNCONSTITUTIONAL For long, I demurred criticizing the Supreme Court because I hold all its Members in the highest regard. Some were my Professors in Law School. Others have been my friends for decades. Some are my clients. But reading the Judgement on FINANCE ACT has shocked me to the core. Supreme Court has held that PUBLIC PARTICIPATION is a Constitutional Imperative but curiosity erases its value completely by holding: “ .. National Assembly is under no obligation to provide reasons for accepting or rejecting public views .. “ If National Assembly has no obligation to provide reasons for accepting or rejecting public views, why then undertake public participation? Why then engage in a WILD GOOSE & ILLUSORY process? Another curious holding was that there is no obligation on Parliament because we have no rules in place! Law is written or established by courts (case law) or law scholarly books & writings or under both local and international customs. We don’t need RULES to give effect to Constitutional Obligations. Unless the Supreme Court reviews this Judgement only on the extent, remit & principles of PUBLIC PARTICIPATION & make it MANDATORY & NOT DISCRETIONARY on Parliament, this will be the Judgment that destroyed democracy as we know it in Kenya. This Supreme Court Judgement on PUBLIC PARTICIPATION is REDUCTIO AD ABSURDUM!

What is truly annoying me about Rigathi Gachagua Impeachment is SHEER HYPOCRISY of our political leaders & more specifically MPs. State Corporations in its employment roll represent the face of the CEO. If you get the list of service providers & suppliers to any State Corporation or County Government , you will find that they are populated by people of the tribe of the CEO or Governor. I wish the energy used by these MPs is used against all that practice Tribalism, Nepotism, Corruption & Money-Laundering in Kenya. Then, Kenya will truly belong to all.

MPs today have painted a Kenya without Tribalism, Corruption & Nepotism. They have told us of a Kenya that employment & development isn’t based on tribe but merit. They have said that development, employment, tenders & resource allocation isn’t based on politics or any other biased consideration. They have said all Kenyans & all Kenyan regions are equal before God & the Constitution. I have been looking forward to that Kenya since I started publishing my thoughts in 1991! A Kenya that won’t discriminate for how one voted or what one believes in. I look forward to this new Kenya. And as look forward to this new Kenya, I pray that those in high offices who said “it is our time to eat” & have been forming companies with their spouses & children for PPPs will not be part of this new beautiful Kenya. It is a beautiful time to be alive in this NEW KENYA. A New Dawn!

Abusing High Court Judge 4. Undermining a Governor 5. Tribalism 6. Nepotism 7. Corruption.
